These Terms of Service ("Terms") govern your access to and use of Mivy. In these Terms, "Mivy," "we," "us," and "our" refer to the Mivy service and its maintainers. By creating an account or using Mivy, you agree to these Terms and acknowledge the Privacy Policy.
1. Eligibility and acceptance
Mivy is intended for adults and is not directed to children. You must be at least 18 and legally capable of agreeing to these Terms where you live.
If you do not agree to these Terms, do not use Mivy. If you use Mivy for an organization, you represent that you have authority to bind that organization.
2. The Mivy service
Mivy is a wellness role-playing game. It lets you complete quests, track game progression, use optional wellness and focus features, customize a character, and use limited social features such as friends and guilds.
Features may change as the service develops. We may add, modify, suspend, or remove features when reasonably necessary to improve Mivy, protect users, comply with law, or maintain the service.
3. Your account
You are responsible for the activity on your account and for keeping your sign-in methods and devices secure. Provide accurate information, use only accounts you are authorized to use, and notify us through the support channels below if you believe your account has been compromised.
Your handle is public, unique, and cannot ordinarily be changed after it is set. Your optional display name is visible to friends and members of guilds you join. Do not choose a handle or display name that impersonates another person, Mivy, or a moderator, or that violates these Terms.
You may delete your account in Settings. Deletion deactivates the account immediately, allows a seven-day recovery period, and then becomes final as described in the Privacy Policy.
4. Wellness and focus features
Connecting wellness data is optional. You can use Focus Session and non-sensor app features without granting Health or Screen Time access, but provider-backed Movement and Sleep quests cannot progress without their data.
Mivy is not a medical device or healthcare provider. Its wellness insights, scores, quests, and rewards are for general informational and entertainment purposes only. They are not medical advice, diagnosis, treatment, or a substitute for professional care. Do not disregard professional advice or delay seeking it because of information in Mivy.
Use your judgment and stay within your abilities when completing any activity. Stop if an activity feels unsafe. Optional app shielding is a focus aid, not an emergency or safety system; make sure you can still access any app or service you may urgently need.
5. Acceptable use
You must not:
- harass, threaten, deceive, impersonate, or exploit another person;
- post or submit unlawful, abusive, infringing, or harmful material;
- cheat, automate gameplay, manipulate wellness inputs, abuse rewards, or evade service limits;
- probe, disrupt, overload, scrape, or gain unauthorized access to Mivy or another user's account;
- introduce malware or use Mivy to distribute spam;
- reverse engineer or circumvent technical protections except where applicable law expressly allows it; or
- use Mivy in a way that violates law, third-party rights, platform rules, or these Terms.
We may investigate suspected misuse and take proportionate action to protect users and the service.
6. Social features and your content
Information you deliberately make visible through social features may be seen by other players as described in the Privacy Policy. You retain ownership of your handles, display names, feedback, reports, and other material you submit.
You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that material only as needed to operate, secure, improve, and support Mivy. This license ends when the material is deleted from the service, except for copies we must retain for legal, safety, security, or backup purposes.
You represent that you have the rights needed to submit your material. Feedback and suggestions may be used without restriction or compensation, but we will not publicly identify you as their source without permission.
7. Virtual items and purchases
Mivy may provide virtual currencies, cosmetic items, and other digital entitlements. They are licensed for personal use within Mivy, have no cash value, are not transferable, and are not a bank account, investment, or property right. We may reasonably correct balances or entitlements affected by error, fraud, refunds, or chargebacks.
The current release may not offer real-money purchases. If purchases are enabled, the applicable app store processes payment and its payment, refund, and subscription terms also apply. Mivy does not receive your payment card details. Except where required by law or the app store's rules, digital purchases are final once delivered.
Deleting your account removes access to its virtual items and progression after the recovery period.
8. Intellectual property
Mivy, including its software, artwork, characters, text, designs, and trademarks, is owned by its maintainers or licensors and is protected by intellectual property laws. These Terms give you a limited, personal, revocable, non-exclusive, non-transferable right to use Mivy for its intended purpose. They do not transfer ownership of Mivy or permit commercial reuse of its content.
Open-source components remain governed by their own licenses.
9. Third-party services
Mivy relies on services provided by companies such as Apple, Google, Supabase, Expo, RevenueCat, and Sentry. Their own terms and privacy policies may apply to your use of their services. We are not responsible for third-party services outside our control, but we select and use processors as described in the Privacy Policy.
Your app store's terms also govern your download and use of the app. If those terms conflict with these Terms on a matter the app store controls, the app store's terms control for that matter.
10. Suspension and termination
You may stop using Mivy at any time. We may restrict, suspend, or terminate access when we reasonably believe it is necessary to address a Terms violation, fraud, abuse, security risk, legal requirement, or material threat to users or the service.
Where practical, we will give notice and an opportunity to appeal. We may act immediately when delay could cause harm or prevent compliance with law. Sections that by their nature should survive termination, including intellectual property, disclaimers, and limitations of liability, will survive.
11. Service availability and disclaimers
We aim to keep Mivy reliable, but we do not promise uninterrupted, error-free, or permanently available service. To the fullest extent allowed by law, Mivy is provided "as is" and "as available," without implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement.
Nothing in these Terms excludes warranties, guarantees, or other rights that cannot lawfully be excluded, including mandatory consumer rights.
12. Limitation of liability
To the fullest extent allowed by law, Mivy and its maintainers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or business opportunities arising from your use of the service.
Nothing in these Terms limits liability where doing so would be unlawful, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where applicable law does not permit that limitation.
13. Changes to these Terms
We may update these Terms to reflect changes to Mivy, law, safety requirements, or our practices. The published Terms show their effective date. If a change materially affects your rights, we will provide reasonable notice through Mivy or another appropriate channel before it takes effect.
Continued use after the updated Terms take effect means you accept them. If you do not agree, stop using Mivy and delete your account.
14. General terms
If a provision of these Terms is unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization or transfer of the service, subject to applicable law.
These Terms, together with the Privacy Policy and any mandatory app store terms, are the entire agreement about your use of Mivy. Applicable law and courts are determined by mandatory law and the rules that apply where you and the Mivy operator are established; these Terms do not take away any consumer forum or protections you cannot waive.
